People abuse the system all the time (for instance, sending DMCAs to things like Anita Sakreesian's youtube videos so that Youtube will automatically take them down.) It's very easy to get away with it for this exact reason, because most content-hosting sites will just immediately fold and remove the so-called "infringing" content.
